Terms and Conditions

Quantock Baby Sitting Agency Ltd is a company registered in England and Wales under number 7359149, registered office is at 113 Darby Way, Bishops Lydeard, Taunton, TA4 3BD 

The Agency is an employment agency under the Conduct of Employment Agencies and

Employment Business Regulations 2003. 

Any and all business entered into by the Agency is subject to these Terms and Conditions.

 1.  Registration and subscriptions

 1.1 To register with the agency you must fill out all of the details of the registration form. 

1.2 You must choose the payment option which is appropriate to yourself and pay by the means as indicated on the website www.quantockbabysitting.co.uk. 

1.3 Upon receipt of the registration form and payment you can access the babysitters. 

1.4 The Agency reserves the right to cancel the registration if you fail to comply with the terms and conditions. 

2.  Bookings 

2.1 Bookings can be made by phone, email or text.   When booking a babysitter please supply the date and approximate start and finish time.   Once confirmed you will be contacted by the allocated babysitter. 

2.2 If you require the babysitter to start earlier than before leaving your children please arrange this with your babysitter, kindly note that babysitters require payment for all of their time. 

2.3 The Agency will always try to accommodate preference for babysitters, however this is not always possible. 

2.4 The Agency has no obligation or liability to you if it cannot allocate a babysitter for any reason. 

2.5 Babysitters will require payment from you in cash at the end of the evening.

 3.  Refunds  

3.1 The one off booking fee is non-refundable once a babysitter has been allocated. 

3.2 If cancellation for a booking is made under 12 hours you will incur a fee this can be viewed on the website www.quantockbabysitting.co.uk this will be paid directly to the babysitter. 

3.3 If the babysitter cancels on short notice the agency will always endeavor to find a replacement however this may not always be possible, in this event you will not be charged a booking fee. 

 

4 The Agency’s Obligations 

4.1 The Agency shall use its best and reasonable endeavors to allocate a babysitter at all times. 

4.2 The Agency will endeavor to ensure that all babysitters meet the criteria as detailed on the website www.quantockbabysitting.co.uk. 

4.3 The Agency will notify you in writing of any changes to current fees. 

4.4 The Agency will ensure that all babysitters are aware and have agreed to comply with the Data Protection Act 1988 regarding any personal information kept on file concerning yourselves. 

5 Your Obligations 

5.1 You will provide the Agency with all of the information which is required on the registration form. 

5.2 You will inform the Agency of any relevant changes as and when as supplied on the registration form. 

5.3 You agree and acknowledge that the Agency is an introduction and booking agency and does not employ the babysitters. 

5.4 You are responsible for payment for the babysitter and agree to the hourly rate which can be viewed on the website www.quantockbabysitting.co.uk 

5.5 All bookings must be made through the agency and must not be made directly to the babysitter, in the event of this your registration will cease with immediate affect. 

5.6 You agree and acknowledge that the subscription fee is non refundable in the event of the agency being unable to secure a babysitter. 

5.7 In the failure to comply with the terms and conditions you agree to compensate the agency for any costs, claims, demands, expenses or other liability incurred. 

5.8 You understand the vetting procedures which the agency undertakes for all of its babysitters and are aware that all babysitters comply to the Data Protection Act 1998 

5.9 You understand that you are directly responsible for the babysitter whilst the babysitter is in your home. 

6.0  You understand that the babysitters are not expected to feed/dress/wash your child/children unless agreed prior to the booking. 

6 Fees and payments 

6.1 Detail of subscription fees, booking fees, cancellation fees, and hourly rates can be viewed on the website www.quantockbabysitting.co.uk 

6.2 The Agency reserves the right to alter the fees as and when required and you will be notified of any changes to fees in writing. 

6.3 You agree to pay the babysitters the hourly rate as stated on the website www.quantockbabysitting.co.uk   for a minimum of 3 hours, the babysitters will be paid for all of the their time and this will be rounded up to the next quarter of an hour. 

6.4 You understand that access to babysitters is on the condition of receipt of subscription fees and registration form only. 

6.5 You agree to pay the booking fees on receipt of invoice. 

7 Renewal/Ending of your subscription 

7.1 Approximately 3 weeks before the end of your subscription, the agency will contact you detailing how you can renew your subscription. You must pay your subscription in full. If you do not re-subscribe at the end of your membership but decide to do at a later date you will need to fill out a registration form and pay the current subscription fee. 

7.2 There is a cooling off period of 10 days, if in this time you wish to cancel your subscription you will receive a full refund of the subscription fee only. 

 8 Data protection and confidentiality

8.1 The Agency agrees to comply with the provisions of the Data Protection Act 1998 and any other relevant data protection legislation from time to time in force when processing or otherwise dealing with any personal data. All such information shall remain confidential. 

8.2 All Babysitter understand and agree to conform to the Data Protection   Act 1998

9 Complaints 

The Agency will always try to deal with any issues, concerns complaints quickly and effectively, if the matter cannot be resolved the Agency will request that you put the complaint in writing, if the complaint cannot be resolved within reasonable time the Agency or you may refer the complaint to ACAS for resolution. 

10 Liability 

With the exception of death or personal injury the Agency shall not be liable or responsible for any loss or damages of any nature whether direct or indirect including any loss of profits or any consequential damages suffered or incurred by you as a result of the introduction of a babysitter to the you by the Agency, or the failure of the Agency to introduce any babysitter to the you. 

11 Indemnity 

You shall indemnify the Agency against any costs, liability, damages, loss, claims or proceedings which may arise out of its use of the services or out of any breach of any part of these Terms and Conditions. 

12. Force Majeure 

Neither party to these Terms and Conditions shall be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that party.   Such causes include, but are not limited to power failure, internet service provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, government action or any other event that is beyond the control of the party in question. 

13.  Law and Jurisdiction 

13.1 These Terms and Conditions (including any non-contractual matters and obligations arising there from or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales. 

13.2 Any dispute, controversy, proceedings or claim between the parties relating to these terms and conditions (including any non-contractual matters and obligations arising therefore or associated therewith)shall fall within the jurisdiction of the courts of England and Wales. 

14.  Privacy

All information regarding registration and subscription are stored in accordance with the Data Protection act 1998.
